That on 7th May, 2007, I have submitted a ‘STRICTLY
CONFIDENTIAL COMPLAINT’, before your Lordship through Registered Post, against
“FIXED ORDERS”, passed by the respective Hon’ble Judges of Delhi High Court, the then Bench headed by the
then Acting Chief Justice of Delhi High Court Mr. Vijender Jain and another Bench headed by the then Judge of Delhi High Court
Mr. Justice Swatanter Kumar, which were passed at the cost of the Integrity of the Propriety and Sovereignty of the Constitution
of India and in serious violation of the Oath taken under Article
219 of the Constitution of India, and violation of their Constitutional function, to protect efficacy of the Judiciary, but
just to save the political carrier of the foreign origin of Smt. Sonia Gandhi, who’s allegiance to a foreign State (ITALY)
is acknowledged and prevails permanently, unequivocally and irrevocably under
the Constitution of Italy and Citizenship Law of Italy, giving rise the impression that Smt. Sonia Gandhi is above the
Constitution of India. Copy of the said Complaint is once again enclosed herewith which self-explanatory, and I repeat
and reiterate what are referred therein, without referring them here once again. However, after submission of the said Complaint
I came to know that the then Acting Chief Justice of Delhi High Court Mr. Vijender Jain was elevated as the Chief Justice
of Punjab and Haryana High Court and Mr. Justice Swatanter Kumar, was elevated as Chief Justice of Mumbai High Court, with
a four elevation of Judges from Delhi High Court within a short span of one year. All this creates
a climate of raising serious doubts that the aforesaid elevations of the then Acting Chief Justice of Delhi High Court
Mr. Vijender Jain as the Chief Justice of Punjab and Haryana High Court and Mr. Justice Swatanter Kumar, as Chief Justice
of Mumbai High Court, looks like that same might have been made under
compromising situation.
One may raise question that why I not filed Appeal against such Order. In this respect without going in detail, I must
refer that I have suffered severe injustice from the Supreme Court Registry, certainly under embracement from Judicial Mafiadom,
which is developed in recent period, thus blocked my right to move Supreme Court, guaranteed under Article 32 of the Constitution
of India. In fact Supreme Court Registry, illegally and unconstitutionally refused to register my Writ Petition, which I filed
under Article 32 of the Constitution. By refusing to register my Writ Petition, gave clear impression that I have no right
to justice against influential and powerful people. My Writ Petition was refused to Register under Order XVIII Rule 5 of Supreme Court Rules, 1966, (substituted by G.S.R. 407 (w.e.f. 20-12-1997). According to agenda item referred
in respective as appears from the certified copy of the file noting received under Right to Information Act, 2005, said Rule
was amended to block the ‘Fax Messages’ received with prayers to register
as Public Interest Litigation. I applied about 57 Applications under Right to Information Act, 2005, before CPIO of Supreme
Court, and get several hundred pages of the Certified Copies of the documents, to justify aforesaid charges against Supreme
Court Registry. Aforesaid Refusal to register my Writ Petition, just benefited to ‘Powerful Land Mafia of Kolkata’,
who is having close Nexus with the powerful politician of Country, justifying the fact that the ‘Fundamental Right of
Equality before the law’ is not exist in India, for the remedy seekers like me, since
I have taken bold stand against unjust and wrong doings and approaches leading to corrupt practices, so much so, even I had
to face several attacks on my person as well as other members of my family, when it came in confrontation with those who mattered
most in State politics. This eventually led me to shift my base from Kolkata to Delhi
for the safety of life of my family and my own-self. However, my fight against corrupt practices goes on unabatedly. We
have all seen in the past and is being experienced more prominently in today’s climate that how the very Fundamental
Rights and Liberties are not only flagrantly violated but even shamelessly recourse is taken without any compunctions to eliminate
those (like me) who dare to stand to point a finger to the violations of the very edifice of freedom by resorting to such
corrupt practices.
Aforesaid situation created by Supreme Court Registry, by refusing to register my Writ Petition, I was strongly restrained,
from moving Supreme Court, against the said Orders passed by then
Acting Chief Justice of Delhi High Court Mr. Vijender Jain and another Bench headed by the then Judge of Delhi High Court
Mr. Justice Swatanter Kumar, committing serious Contempt of the Supreme Court, by overruling the effect of Supreme Court Judgments.
However, some people misused such Fixed Orders of Delhi High Court, against me, thus I decided to remove the tag of ‘STRICTLY
CONFIDENTIAL COMPLAINT’, and hereby my aforesaid Complaint would be open for the Public. However, copy of the same was
also posted, at the same time i.e. on 7th May, 2007, to Smt. Sonia Gandhi,
Attorney General of India Ld. Mr. Millon Banerjee, Additional Solicitor General of India Mr. Gopal Subramanium (who once ditched
me in his capacity as my Counsel), and Hon’ble Mr. Justice Swatanter Kumar, all by Registered post. In this context,
I must add more fact relating to threat caused by the Government pleader in the aforesaid matter of Delhi High Court. That
immediately after Bench headed by the then Hon’ble Mr. Justice Swatanter Kumar of Delhi High Court completed the hearing
in the said matter and left for Chamber, on 9th March, 2007 Ld. Mr. Rajeeve Mehra, Advocate, the Government Counsel
in the matter, in presence of several Advocates threaten me in a manner as if he is threatening me with dire consequences.
I sent a letter to him on 9th March 2007 by Registered Post, which was returned to me with postal remarks “Left”.
I have kept the said letter packed in cover, in my custody.
Therefore, hereby once again I humbly pray before your Honors to adopt punitive measures against Contempt of the Hon’ble
Supreme Court’s Judgments, particularly when committed by High Court Judges, since committing of Contempt of Supreme
Court Judgments by High Court Judges in violation of Article 141 of the Constitution, is more serious then committed by a
Common man. This is warranted to protect Efficacy of the Supreme Court and remove the serious effect that Smt. Sonia Gandhi
is above the Constitution of India. And I hereby further prayed that Your Honor should enquire whether aforesaid Elevations
were result of any compromising situation? This is a very serious matter and to establish the efficacy of the Oath under the
Constitution of India taken by Judges of Supreme Court as well as of the High Courts, it should be looked in to seriously.
Otherwise Oath would become meaningless, and growth of the corruption, within the judiciary cannot be stopped.
